A Community Land Management Plan (CLMP) provides high-level guidance on how Council intends to manage community land. It identifies the land covered by the plan, the purpose for which the land is held, Council’s management objectives and proposals, and performance targets and measures. Council must then have regard to the CLMP when making decisions about the management and use of the land. Council is the approving authority for a CLMP.

There was not previously a standalone Community Land Management Plan specifically for the Patawalonga Lake & Surrounds. Instead, the land was included within Council’s broader Regional Open Space Community Land Management Plan, which covered several separate parcels of community land across the City of Holdfast Bay.

Council is now proposing a more targeted approach by establishing a dedicated Community Land Management Plan for the Patawalonga Lake & Surrounds.

Having a dedicated CLMP allows the unique characteristics and uses of the Patawalonga Lake & Surrounds to be considered in greater detail and provides a clearer, more specific framework for this important area.

Under the former CLMP, permitted activities were relatively limited, primarily accommodating community and special events, together with the use of buildings for kiosks or similar purposes.

The proposed Patawalonga Lake & Surrounds CLMP adopts a more targeted and contemporary approach, recognising the unique characteristics of the Patawalonga precinct and providing greater flexibility for its future use and activation.

In particular, the draft CLMP broadens the range of contemplated uses and activities to include:

• Hospitality and food services: Cafés, kiosks, restaurants, food and beverage services, and mobile food vendors.
• Commercial and community activities: Commercial, cultural, educational, recreational and community-based uses.
• Events and temporary activations: Festivals, markets, performances, exhibitions, seasonal activities, trials and pop-up initiatives.
• Water-based activities and infrastructure: Floating and pontoon-based buildings, structures, facilities and businesses, including uses associated with wellness, recreation, tourism, hospitality, retail, entertainment and visitor experiences.
• Health and wellbeing: Fitness, wellness, personal training facilities, programs and services.
• Marine and aquatic activities: Marina operations, mooring, boating, aquatic recreation and associated services.
• Public infrastructure and amenities: Public art, telecommunications, utilities and supporting infrastructure.
• Operational and supporting uses: Car parking, access, storage, maintenance and other ancillary or complementary activities associated with authorised uses.

Importantly, the proposed CLMP does not provide automatic approval for these activities. Rather, it establishes a broader framework within which proposals may be considered, subject to relevant statutory requirements, environmental considerations, consultation obligations and any necessary Council or external approvals.

This approach provides Council with greater flexibility to consider future opportunities for the Patawalonga Lake & Surrounds precinct, while ensuring individual proposals remain subject to appropriate assessment and approval processes.

Council is also undertaking a broader review of its Community Land Management Plans across the City of Holdfast Bay. The remaining plans will be released for community consultation in the coming months, providing further opportunities for the community to provide feedback on the future management of community land across the city.

A CLMP is required where community land has been, or is to be, specifically modified for the benefit or enjoyment of the public, or where the land is, or is intended to be, occupied under a lease, licence or permit. The Patawalonga Lake & Surrounds includes a range of community land uses for recreational, tourism, commercial and operational purposes.

The draft CLMP applies to a connected area comprising of:

• the Patawalonga Lake and adjacent land, including the waterway, banks
• shared paths and landscaped areas
• the boat lock
• Glenelg Marina Channel
• Patawalonga Pier adjacent to Wigley Reserve
• the Patawalonga Slip and;
• Wigley Reserve
  

The Community Land Register identifies the ownership, trust, dedication or other restrictions applying to individual parcels.

The proposed plan provides a clearer and more contemporary management framework specifically tailored to the Patawalonga Lake & Surrounds. It brings together the recreational, tourism, commercial and infrastructure functions of the precinct and links the management of the land to Council’s broader strategies, plans and policies.

The draft plan contains six objectives, which are intended to carry equal weight. They focus on stormwater management functions of the Patawalonga Lake system; providing safe, accessible and enjoyable recreation; enabling compatible recreational, tourism and commercial uses; providing suitable areas for community events, cultural activities and public gatherings; and maintaining and renewing infrastructure using a whole-of-life asset management approach.

Yes. The draft plan provides for compatible commercial and tourism activities where they are consistent with the CLMP and relevant legislative, amenity and Council policy requirements. Examples identified in the draft include marina and associated uses, floating, water-based or pontoon-based tourism and visitor experiences, retail, markets, precinct-based business activations, events and other short-term or temporary uses.

No. The CLMP provides the high-level framework for the types of uses that may be considered. Any specific proposal would still need to go through the relevant Council assessment and approval processes and comply with applicable legislation, policies, permits, licences, requirements and any land-specific restrictions. Inclusion in the CLMP does not guarantee approval of an individual proposal.

The community land covered by this draft CLMP forms part of the broader Patawalonga Lake System. The Patawalonga Lake System is managed and controlled by the Department for Environment and Water, while Council manages the reserve land, public realm, pathways, and Council-owned assets. The operation and management of the Patawalonga Lake System, including its environmental and stormwater management functions, is undertaken and the responsibility of the Department for Environment and Water (DEW).

The draft CLMP seeks to ensure the Patawalonga Lake & Surrounds remains safe, accessible and enjoyable for walking, cycling, passive recreation and community use. It proposes improvements to accessibility and universal design across shared paths, trails, viewing areas and open space, as well as stronger connections between the Patawalonga, Glenelg Foreshore, Wigley Reserve and surrounding precincts.

Yes, where the proposed use is consistent with the CLMP and relevant legislation. The draft CLMP provides that leases and licences for terms of less than five years may be granted where consistent with the plan. Proposals for terms longer than five years are subject to public consultation in accordance with Council’s public consultation requirements and the Local Government Act 1999. Crown land is also subject to the requirements applying to Council as custodian.

If a proposed lease or licence is inconsistent with the CLMP, the plan would first need to be amended in accordance with the Local Government Act 1999 before that proposal could proceed under the plan.

The draft CLMP includes performance targets and measures. These include indicators relating to accessibility of paths and trails, community satisfaction, pedestrian and cyclist use, visitor participation, compliance of commercial activities, delivery of community and cultural events, and the condition and renewal of infrastructure.
